    Shopping with GrandCruStore means buying your wines directly from the producer or négociant in France. Giving our customers access to the full range of wines of our partners in France. And avoiding costs and stock at wholesalers and distributors. We also aim to keep shipping charges as low as possible. To this end, we gather all orders from our customers over a period of time before organizing all logistics. The planned week of delivery is indicated in the “Delivery” box on the website. Article 1 - Scope

  1. These general conditions apply to every offer from GrandCruStore and to every distance agreement that is concluded between GrandCruStore and customer.
  2. In the event that in addition to these terms and conditions specific product or service conditions are applicable, the customer can in case of conflicting terms always appeal to the applicable stipulation that is most favourable for the customer.
  3. Placing an order implies that the customer unconditionally accepts the applicability of these general conditions.
  4. GrandCruStore reserves the right to modify these terms and conditions at all times.

Article 2 - The offer

  1. The offer of GrandCruStore is non-binding and is made subject to availability and price changes. In case a wine is unfortunately no longer available in the quantity ordered or for the price advertised, the customer will be informed within five working days after receivement of payment and the original invoice will be lowered with the price of the number of discontinued bottles of wine as listed on the original invoice and, if applicable, any variable shipping charges attributable to those specific products. Refund of an already made payment will take place within 10 working days and to the account which was also used to pay for the order.
  2. Pictures of bottles or labels may differ from the actual products delivered.
  3. GrandCruStore does not sell wine to persons under 18 years of age. Delivery will only take place if the person accepting the wines is over 18 years of age. In case of any doubts the recipient will be asked to show an ID-card.
  4. Wines will be delivered by GrandCruStore in the original packaging (wooden case or cardboard box) of the château or domain if possible from a safe shipping perspective; if this is not possible, the wines will be delivered in a transport-safe box and the original wooden side of the case showing the name of the Château will be included if available.

Article 3 - The agreement

  1. The agreement is concluded, subject to the provisions of paragraphs 2 and 3, at the moment at which the customer accepts the offer and the applicable payment conditions have been fulfilled.
  2. In the unexpected case a wine is no longer be available, GrandCruStore will modify the agreement as described in Article 2 paragraph 1.
  3. GrandCruStore may obtain information - in accordance with statutory frameworks - about the customer's ability to fulfil his payment obligations, and also about facts and factors that are important for a responsible conclusion of the distance agreement. If that research provides GrandCruStore with good grounds for declining to conclude the agreement, then GrandCruStore has the right to reject an order or application or to bind its implementation to special conditions, thereby stating the grounds for this decision.
  4. The ownership of products is transferred only after the customer has fulfilled all what was due to GrandCruStore according to the agreement.

Article 4 - Right of withdrawal upon delivery of products

  1. When purchasing products, a customer is able to dissolve the agreement, without stating reasons, during 14 week-days ("right of withdrawal").This period commences on the day following receipt of the product by or on behalf of the customer.
  2. The customer can only use his right of withdrawal as long as the packaging of the bottles of wine (the wine case or cardboard box) has not been opened.
  3. If the customer wishes to exercise his right of withdrawal, then he will return the product with all accessories and in original condition and unopened packaging to GrandCruStore, in accordance with the instructions provided by GrandCruStore.
  4. If the customer makes use of his right of withdrawal, he will be charged with the costs of returning the goods.
  5. If the customer has paid a sum, GrandCruStore will refund this sum minus the costs of returning the goods as soon as possible, within 30 days at the latest.
  6. Right of withdrawal is excluded for wines which have been packaged by GrandCruStore according to customer specifications, for example for (business) gifts.

Article 5 - Price and payment

  1. The prices shown on the website include VAT and other taxes such as excise duties and packaging/waste disposal duties, and exclude shipping charges.
  2. Prices are in Euros.
  3. Payment options are listed on the website and may vary by country.
  4. For special orders (such as gifts) the standard payment term is 14 days after invoice date.
  5. When exceeding the payment term an interest of 1% per month or part of a month is due on the outstanding amount. If GrandCruStore sends a dunning letter because of non-payment, a sum of ten Euros (€ 10.00) administration costs will be charged and if GrandCruStore outsources its payment collection, the customer must also pay for the collection charges.
  6. If the customer defaults on any payment, GrandCruStore is entitled to suspend the execution of the concerning agreement and related agreements or cancel these without notice, without losing its rights.

Article 6 - Delivery

  1. The place of delivery is deemed to be the address that the customer has made known to GrandCruStore.
  2. Delivery times stated by GrandCruStore are only indicative. Late delivery does not entitle the customer to compensation or the right to cancel the order or the agreement, unless the delay in delivery is such that the customer cannot reasonably be expected to leave the agreement intact. The customer is in that case entitled to cancel the order or terminate the agreement where necessary.
  3. The delivery charges are indicated on the website. For orders in special (gift) packaging different delivery charges might apply, as determined by GrandCruStore.
  4. The risk of damage and/or loss of products rests upon GrandCruStore up to the moment of delivery to the customer.
  5. The customer has the obligation to check at delivery whether the products meet the agreement. If this is not the case, the customer must inform GrandCruStore within two working days after delivery in writing and motivated. If it is demonstrated that the products do not meet the agreement, for example, incorrect delivery or breakage, GrandCruStore has the choice to replace the products, if requested on their return, by new products or to refund the invoice value.

Article 7 - Wine storage

  1. GrandCruStore offers customers the opportunity to temporarily store the wines they have purchased at GrandCruStore against a fee in its own specially equipped warehouse.
  2. The agreement for wine storage is for an indefinite period and will automatically terminate when the customer requests delivery of the last stored case(s) of wine from the warehouse.
  3. The customer is responsible for insuring the stored wines.
  4. GrandCruStore accepts no liability for damage caused by burglary, theft, fire or force majeure.

Article 8 - Force majeure

  1. Without prejudice to its other rights, in case of force majeure GrandCruStore has the right, at will, to suspend the execution of the agreement or cancel the agreement without judicial intervention, and without any liability for or compensation by GrandCruStore, unless this would be unacceptable under the circumstances and according to standards of reasonableness and fairness.

Article 9 - Privacy

  1. All personal information that is entered on the website is carefully handled, not sold to third parties and used only for the best possible customer service.
  2. For security reasons GrandCruStore does not store payment details.

Article 10 - Applicable law

  1. To all rights, obligations, offers, orders and agreements to which these general conditions apply, including these general terms and conditions, only Dutch law applies.
  2. All disputes between parties will be brought before the competent court in the Netherlands.
